Terms of Service
Welcome to Innovative Cinema! I am Ron Williams, I'm thrilled to have you as a valued customer. Please carefully read these Terms of Service before using our photography services. You agree to be bound by these Terms by accessing or using our services. If you do not agree with any part of these Terms, then you may not access our services.
1. Services
A. Photography Services: Innovative Cinema provides professional photography services for various occasions, including but not limited to events, portraits, weddings, and commercial projects.
B. Booking and Payments: To secure our services, a non-refundable deposit is required at the time of booking. The remaining balance is due on the day of the event or as otherwise agreed upon.
2. Cancellation and Rescheduling
A. Client Cancellation: In the event of client cancellation, the deposit is non-refundable. However, we understand that unforeseen circumstances may arise, and we may consider rescheduling on a case-by-case basis.
B. Photographer Cancellation: If, for any reason, we are unable to fulfill our photography services, a full refund will be provided to the client. We will make every effort to provide advance notice and, if possible, assist in finding a suitable replacement photographer.
3. Intellectual Property
A. Ownership: All photographs and related intellectual property remain the exclusive property of Innovative Cinema. Clients are granted personal use rights, including printing, and sharing for non-commercial purposes.
b. Commercial Use: Any commercial use of photographs requires prior written consent and may be subject to additional fees.
4. Image Delivery
A. Delivery Time: The delivery timeline for edited images will be communicated to the client. Delays due to unforeseen circumstances will be communicated promptly.
B. Editing Style: Innovative Cinema retains the creative right to edit photographs in a style consistent with our portfolio.
5. Client Cooperation
A. Cooperation: The client shall provide necessary cooperation to ensure the success of the photography session, including but not limited to a list of desired shots, key contacts, and a suitable shooting environment.
6. Privacy
A. Client Privacy: We respect the privacy of our clients. Any personal or sensitive information provided will be kept confidential.
B. Portfolio Use: Innovative Cinema may use select images for promotional purposes unless otherwise specified by the client.
7. Liability
A. Limitation of Liability: Innovative Cinema is not liable for any unforeseen events or circumstances that may negatively impact the delivery of services.
B. Damages: Our liability is limited to the amount paid for the photography services.
8. Governing Law
The laws of Texas govern these Terms. Any disputes arising from these Terms will be resolved through arbitration by the rules of the Arbitration Association, and judgment upon the award rendered may be entered in any court having jurisdiction thereof.
